Ms. Rowling, threats and hot air have no weight here, in this forum where cogent and coherent arguments are aired. Congratulations, you are the proud creator of a modern myth. Now that myth shall evolve and change, as all myths do. 'Tis a literary phenomenon, and there's not much you can do about it. So sit back and enjoy the ride. Two thousand years from now, your work will be studied just as Homer's Odyssey is studied today.

To the Warner Brothers: Agreed. Creative derivative works without profit are acceptable. Is there anything left to argue about or can we consider the situation resolved?

Tis a terrible thing to do, right now as i sit in my estate in Edinburgh sipping on tea and crumpets I am simply disgusted. How someone could taint Harry's image is beyond me. To me this is an obvious infringement of the copyright law and something that needs to be taken care of. I did not spend my entire life writing these stories to have them turned into such rubbish. I think Mr. Neely needs to retract his actions if he knows whats good for him. My lawyers will pin him to the wall.

Neely's logic for his actions is based primarily on copyright law's allowance for derivative works. He also makes an appeal to the reader's emotions by accounting the genesis of the project -- a joke in a bar with friends. He appeals to Americans' love of fun and freedom; Americans like to be entertained and they want to do what they want to do and not be told what to do. As ethos goes, Neely appeals not to authority but to his fellow citizens. His work has created a respectable following, and if so many people like it, what's the problem?

I should be permitted to display this innovative new copyright infringing perspective on Harry Potter on my website, illegal-art.org. It provides Harry Potter fans across the globe with an interesting humorous twist on the normal Harry Potter series, why should fans be deprived of this material? The internet is an outlet for individuals to display their creative works, however, Warner Bros. is attempting to censor our freedom of expression via this outlet. This should not be allowed to happen.

Warner Brothers Position

We are opposed to the sale of "Wizard People, Dear Reader" as it clearly infringes upon copyright law. The sale of this product is theft of a creative production. However, we are not opposed to the distribution of this product as a free work of entertainment (i.e. no one makes a profit).

This project started as something fun between friends and has spread to the general public however, I have taken no credit for the making of the Harry Potter movie I am not making much money off of the project and therefore pose no competition for the actual film.

JK Rowling

In my opinion, JK Rowling has full right to demand that illegalart.org take down the files due to copyright infringement. The audio files are clear copyright infringement because they are using the names and places that are used in the books, which are copyrighted by Ms. Rowling, thefore it is her property. She has the rights to the names, thefore by using them in the files they are using her property without paying her for the rights to use her work. Even if he is making only a little money, then he is still making money using her work, therfore he must pay her for use of her topics, and she still reserves the right to refuse him the privelage to use her characters in his own work. Illegalart.org is infringing upon her copyright, hence is operating illegally.
